Terms of Use for Seniornomic Elder Care App

This document (“Terms of Use” or “Terms”) is a legally binding agreement between you (“User,” “You,” “Customer,” or “Subscriber”) and Seniornomic, a service provided by Joyful Life Private Limited (“We,” “Us,” “Our,” or “Seniornomic”). By accessing or using the Seniornomic website, mobile application, or call center services (collectively, “Seniornomic Apps”), you agree to these Terms. If you do not agree, you must immediately cease using the Seniornomic Apps.
These Terms are an electronic record under applicable laws and do not require physical or digital signatures. We reserve the right to amend these Terms at Our sole discretion, with updated versions superseding prior ones upon posting on the Seniornomic Apps. Additional terms may apply to specific Packages, Products, or Services and will be disclosed where relevant.
1. Definitions
Seniornomic: Joyful Life Private Limited, a company registered at A194-195, Sector 63, Noida, 201309, UP, India, including its directors, successors, and permitted assigns, operating the Seniornomic Apps to deliver elder care solutions.
Seniornomic Team: Employees, sponsors, vendors, channel partners, affiliates, independent contractors, service providers, and representatives engaged by Seniornomic.
Seniornomic Apps: The website, mobile application, and call center services owned, controlled, and updated by the Seniornomic Team.
User/Customer: An individual or entity who registers an Account on the Seniornomic Apps to access or purchase elder care Packages, Products, or Services, whether free or paid.
Account: A profile created by a User on the Seniornomic Apps for accessing services.
Packages: Bundled elder care products and/or services (e.g., monthly caregiving plans) purchased once and delivered over a specified period.
Products and Services: Individual offerings (e.g., medical supplies, teleconsultations, in-home care) available through the Seniornomic Apps.
Purchases: Confirmed orders placed by a registered User for Packages, Products, or Services.
Price: The amount payable in local currency for Packages, Products, or Services, as displayed on the Seniornomic Apps, exclusive of taxes unless stated otherwise.
Applicable Taxes: Taxes, duties, levies, or tariffs payable under local laws for Purchases.
Additional Charges: Fees paid by Seniornomic to third parties for value-added services (e.g., doorstep delivery, technology support) that may be passed to the User.
Access, Convenience, or Service Charge: Fees charged by Seniornomic for specific services (e.g., premium support).
Incidental Charges: Costs related to volume, packaging, distance, or delivery timing, calculated at fulfillment if not predetermined.
Cancellation Fee: Charges imposed for canceling a Purchase, as specified during ordering.
City of Operation: The geographic area where a User requests delivery of Packages, Products, or Services.
Third Party: Platforms, vendors, or individuals contracted by Seniornomic to deliver services, holding necessary permits within the City of Operation.
E-Wallet: A prepaid digital payment instrument integrated into the Seniornomic Apps.
Applicable Laws: All statutes, regulations, ordinances, and judicial orders of the country where the Seniornomic Apps are used.
Your Data: Valid, accurate personal information provided by You during registration and updated periodically, plus data collected during service use (e.g., health records).
Force Majeure: Events beyond Our reasonable control (e.g., war, natural disasters, cyberattacks, strikes, crime, riot, strike, hurricane, tornado, flooding, volcanic eruption, failure of App due to technical reason) impacting service/ Product delivery.
2. Scope and Acceptance
Purpose: These Terms govern your use of the Seniornomic Apps to access elder care solutions, including caregiving, medical consultations, emergency support, and supplies tailored to seniors.
Acceptance: By clicking “Accept” or using the Seniornomic Apps, you acknowledge and consent to these Terms. Continued use constitutes ongoing acceptance.
Modification: We may modify these Terms at any time without prior notice. The latest version applies upon posting on the Seniornomic Apps, and your continued use signifies acceptance of changes.
Supplemental Terms: Additional terms for specific Packages, Products, or promotions (e.g., limited-time offers) will be provided and form part of these Terms where applicable.
3. Agreement Duration
Effective Date: This Agreement begins when you first access or use the Seniornomic Apps.
Duration: It remains in effect for each Purchase until terminated by either party as outlined in Section 11.
Perpetuity: The Agreement persists as long as you maintain an active Account, subject to termination provisions.
4. User Registration and Obligations
Registration Requirement: Access to Purchases or browsing requires a registered Account. Anonymous use is not permitted.
Single Account: You may maintain only one Account linked to your Registration Data. Multiple accounts are prohibited.
Accurate Information: You must provide true, current, and complete Registration Data (e.g., name, contact details, medical history) and update it as needed.
Equipment Responsibility: You are solely responsible for obtaining and maintaining necessary equipment (e.g., smartphone, internet connection) and bearing associated costs (e.g., data fees).
Lawful Conduct: You agree to:
Use the Seniornomic Apps for lawful purposes only (e.g., elder care coordination, not resale without permission).
Comply with all Applicable Laws, including health and privacy regulations.
Refrain from actions that harm, disrupt, or impair the Seniornomic Apps (e.g., hacking, reverse-engineering, uploading malware).
Identity Verification: For certain Purchases (e.g., prescription medications, emergency services), you must provide proof of identity or authorization as required by law.
Authorized Use: You may use your Account on behalf of another (e.g., a senior relative) only with proper authorization (e.g., power of attorney).
Contact: Report Account issues (e.g., unauthorized access, inability to log in) immediately to info@seniornomic.com .
5. Services, Purchases, and Payments
Offerings: Seniornomic Apps provide elder care Packages, Products, and Services, including:
In-home caregiving (e.g., daily assistance, companionship).
Telehealth consultations with geriatric specialists.
Delivery of medical supplies (e.g., mobility aids, medications).
Emergency response coordination.
Alert systems for detecting deviations in user health or behavior patterns.
Ordering Process: Purchases are made via confirmed orders on the Seniornomic Apps, with delivery schedules specified at checkout.
Pricing: Prices are displayed in local currency and may include Applicable Taxes, Additional Charges, Incidental Charges, or Service Charges. All fees are disclosed prior to payment.
Payment Methods: Payments are accepted via E-Wallet, credit/debit cards, or other secure options provided on the Apps.
Delivery: Services are fulfilled in the User’s City of Operation by Seniornomic or Third Parties with appropriate permits.
Cancellation and Refunds:
You may cancel Purchases subject to a Cancellation Fee, detailed at the time of order.
Refunds, if applicable, are processed per Our refund policy, excluding non-refundable fees (e.g., service charges).
Add-Ons: Optional Services (e.g., 24/7 monitoring) are offered as add-ons with additional terms, which you accept upon selection.
No Resale: You may not resell Packages, Products, or Services for commercial purposes without Our written consent.
Misrepresentation Prohibited: You are not allowed to use a false email address, impersonate any person or entity, or mislead as to the origin of any information or content.
6. Data Privacy and Consent
Data Collection: We collect Your Data (e.g., name, address, health conditions, payment details) to provide and improve services, as detailed in Our Privacy Policy.
Rights Granted: You grant Seniornomic a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use Your Data in any media for:
Service delivery (e.g., sharing with caregivers).
Analytics and app improvement.
Compliance with legal obligations.
Communications Consent: You permit the Seniornomic team to communicate with you or your kin via phone calls, emails, couriers, WhatsApp, SMS messages, alerts, and notification tones to offer products or services. You agree to disable the ‘Do Not Call Registry’ for such communications.
Third-Party Sharing: We may share Your Data with Third Parties (e.g., healthcare providers, insurers) to fulfill Purchases, with your explicit consent where required by law (e.g., GDPR, HIPAA).
Incidental Charges Notification: In certain cases, incidental charges may arise that are not estimable at order placement. These will be communicated to you by the delivery partner and must be paid at or during delivery.
Communications: You consent to receive service-related and promotional messages (e.g., appointment reminders, care tips) from Seniornomic or Third Parties via phone, email, or the Apps. You may opt out of promotional messages but not critical service updates.
Data Security: We implement industry-standard safeguards (e.g., encryption) to protect Your Data but are not liable for breaches beyond Our control (see Section 12).
Data Retention: Your Data is retained as long as necessary for service delivery or legal compliance, then securely deleted per applicable regulations.
7. Intellectual Property
Ownership: Seniornomic owns all intellectual property rights (e.g., copyrights, trademarks, patents, trade secrets) in the Apps, Services, Products, and content (e.g., text, images, software, care guides).
User Restrictions: You may not:
Copy, modify, distribute, sell, or create derivative works from the Apps, Services, or content without Our written consent.
Use Our intellectual property for commercial purposes.
Reverse-engineer, decompile, or tamper with the Apps’ software.
Third-Party IP: Third-party trademarks or content (e.g., vendor logos) on the Apps belong to their owners. You must obtain their permission for use.
Feedback: Suggestions, ideas, or feedback you provide become Our property without compensation, though We are not obligated to implement them.
Infringement Claims: If you believe content on the Apps infringes your rights, notify Us at info@seniornomic.com with details for review and removal if warranted.
8. Liability and Indemnity
No Warranties: The Seniornomic Apps and Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, regarding functionality, accuracy, availability, or fitness for a particular purpose.
Limitation of Liability: To the fullest extent permitted by law, Seniornomic is not liable for:
Damages (e.g., direct, indirect, incidental) from your use or inability to use the Apps or Services.
Third-party actions or failures (e.g., caregiver negligence, delivery delays).
Losses due to Force Majeure events (e.g., earthquakes, cyberattacks).
Health outcomes resulting from Services, as We are not a healthcare provider.
Loss of communication or information about status updates and benefits sent to your registered mobile or email. You are responsible for the accuracy of your contact details and for reporting any issues.
Indemnity: You agree to indemnify, defend, and hold harmless Seniornomic, its affiliates, and the Seniornomic Team from claims, damages, losses, or expenses (including legal fees) arising from:
Your breach of these Terms or Applicable Laws.
Your misuse of the Apps or Services (e.g., unauthorized sharing of access).
Your violation of third-party rights (e.g., IP infringement, defamation).
Force Majeure: We are not liable for delays or failures due to events beyond Our control, including but not limited to acts of God, war, riots, curfew, lockdown, cyberattacks, power outages, or regulatory changes.
9. Scenarios Reflecting Prevailing Internet Laws
Data Breach (GDPR/CCPA Compliance):
We will notify affected Users within 72 hours or as required by law and provide relevant details.
Accessibility Violation (ADA Compliance):
We will meet WCAG 2.1 standards and provide alternative access during updates.
Misleading Advertising (Consumer Protection):
If packages are misleading, we will issue refunds or correct the description.
Third-Party Service Failure:
We will mediate issues but are not liable for external vendors’ failures.
Unauthorized E-Wallet Use:
Seniornomic is not responsible for unauthorized use of your E-Wallet. Payment issues must be resolved with the Payment Processor unless caused by our App.
AI Misdiagnosis Risk:
AI tools are for informational use only and are not substitutes for medical advice.
We are not liable for health outcomes due to reliance on AI tools.
Alert Failure Liability:
We are not responsible if alerts are missed due to device settings, lack of E-Wallet balance, or user inaction. Users must maintain a balance to prevent service disruptions.
Subscription Overcharge:
Billing issues will be corrected, and refund issued if charges are made after cancellation.
Content Moderation:
Inappropriate content will be removed. Accounts may be suspended or reported to authorities if required.
10. Termination
By User: You may terminate this Agreement by deleting your Account or contacting support.
By Seniornomic: We may suspend or terminate your Account for reasons including:
Providing false or incomplete Registration Data
Breach of Terms or laws
Compromised Account security
Effect of Termination:
Access will cease
Purchases may be canceled (with fees applied)
Data will be retained or deleted per Privacy Policy
Assignment: You may not assign your Account. We may assign our rights without restriction.
11. Governing Law and Dispute Resolution
Governing Law: Laws of your location apply.
Arbitration:
Disputes will be resolved by binding arbitration in English, in your City of Operation, per local rules.
Court Jurisdiction: Courts in your country have jurisdiction if arbitration fails.
Severability: Invalid clauses do not affect the rest.
Waiver: Rights not enforced immediately are not waived.
Legal Costs: You will reimburse Us for legal expenses resulting from your misconduct.
12. Security Incidents
Notification: You will be notified within the legal time frame in the event of a data breach.
Details Provided: We will disclose relevant facts to allow you to act responsibly.
No Liability: Notification does not imply fault on our part.
13. Miscellaneous
Survivability: Sections like Intellectual Property, Indemnity, and Dispute Resolution survive termination.

Entire Agreement: These Terms and our Privacy Policy form the complete agreement.
Language: English version prevails in case of translation discrepancies.
Responsibility for Communication: Seniornomic is not responsible for loss of communication due to incorrect or inaccessible mobile or email details. You must report any issues immediately.

1. General Disclaimer
- The Seniornomic App is provided on an “as is” and “as available” basis. While we strive to provide accurate and reliable elder care services, we do not guarantee uninterrupted, error-free, or flawless operation of the App or its services.
- We are not responsible for any inaccuracies, delays, or failures in service delivery caused by technical issues, third-party errors, network failures, or unforeseen circumstances.
2. No Medical Advice or Healthcare Guarantee
- Seniornomic is not a healthcare provider and does not offer professional medical advice, diagnosis, or treatment. The information and services provided are for informational purposes only and should not be considered a substitute for professional medical consultation.
- Users should consult a qualified healthcare professional before making any medical decisions based on the information provided by the App.
- We are not liable for any health complications, injuries, or adverse outcomes arising from misinterpretation of information, delayed responses, or reliance on AI-based health insights in the App.
3. Third-Party Services and Liability
- Seniornomic partners with third-party service providers (e.g., caregivers, medical supply vendors, telehealth providers) to deliver certain services.
- We do not assume responsibility for the quality, timeliness, or reliability of services provided by these third parties. Any issues regarding their performance should be addressed directly with the respective service provider.
- In cases of third-party failure (e.g., a caregiver missing an appointment or a delivery being delayed), our role is limited to facilitating communication and offering support where possible.
4. Communication and Alerts
- Seniornomic may send alerts, reminders, and notifications via SMS, WhatsApp, emails, push notifications, or phone calls.
- We are not responsible for missed, delayed, or undelivered notifications due to:
- Technical issues (e.g., server downtime, mobile network errors)
- User settings (e.g., notifications turned off, incorrect contact details)
- Insufficient balance in the User’s E-Wallet, affecting service continuity
- Users are responsible for keeping their contact details updated and ensuring they receive critical alerts.
5. Payment and E-Wallet Disclaimer
- All payments made through the App (including E-Wallet transactions) are processed through third-party payment gateways. We do not store payment details and are not responsible for unauthorized transactions, fraud, or technical payment failures.
- Users must report unauthorized transactions to their bank or payment provider immediately. Seniornomic does not offer refunds for payments lost due to incorrect details, fraudulent activity, or technical issues beyond our control.
Certain incidental charges (e.g., doorstep delivery fees, local levies) may not be known at the time of order placement. Users are responsible for paying these charges as communicated by the delivery partner.
6. Force Majeure Events
We shall not be liable for any failure, delay, or disruption in services due to events beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, storms, pandemics)
- Cyberattacks, server failures, or hacking incidents
- Strikes, labor disputes, or governmental actions
Power outages, internet failures, or mobile network disruptions
7. Limitation of Liability
- To the fullest extent permitted by law, Seniornomic is not liable for:
- Any direct, indirect, incidental, or consequential damages arising from your use of the App or services.
- Any health-related complications due to reliance on AI-based recommendations, delayed responses, or failure to follow medical advice.
- Any data breaches, cyber incidents, or unauthorized access beyond our reasonable control.
- Any service failure due to third-party actions, including caregivers, healthcare professionals, or payment processors.
- Seniornomic‘s total liability, if any, shall be limited to the amount paid by the user for the affected service in the past three (3) months.
8. Data Privacy and Security
- We take reasonable security measures to protect your data. However, we do not guarantee complete security from cyber threats or unauthorized access.
- Users should take necessary precautions (e.g., using strong passwords, to safeguard their accounts.
- In case of a security breach, Seniornomic will notify affected users as required by applicable laws but shall not be held liable for any data misuse resulting from such incidents.
9. Subscription and Billing Transparency
- Users are responsible for reviewing subscription details and billing terms before purchase.
- If a user is charged after cancelling a subscription due to billing cycle overlaps or technical delays, they may request a refund as per our refund policy.
- Refunds are subject to non-refundable fees (e.g., service charges, administrative costs) as disclosed at the time of purchase.
10. Changes to This Disclaimer
- Seniornomic reserves the right to update or modify this Disclaimer at any time without prior notice.
- The latest version will always be available within the App, and continued use of the App after changes implies acceptance of the revised Disclaimer.
